5.1 USAGE LICENSE

Subject to your compliance with these Terms, Rootpay grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the App solely for your individual, non-commercial purposes. This license does not permit you (nor any third party acting on your behalf) to: copy, modify, reverse engineer, decompile, disassemble, or attempt to derive source code from the App; create derivative works; distribute, sell, assign, sublicense, transfer, or grant any security interest in the App, Services, or related content; or use modified versions of the App or Services without Rootpay's express written consent. You must not attempt unauthorized access to the App, its underlying systems, software, or networks. Redistribution of any content or materials from the App or Services is strictly prohibited unless explicitly authorized by a separate written agreement with Rootpay.

5.2 ACCOUNT ELIGIBILITY AND CREATION

Throughout these Terms, "you" and "your" refer exclusively to individual users. The App is designed for personal use by natural persons and is not intended for use by business entities, organizations, or automated agents. You represent and warrant that all information you provide to Rootpay is truthful, accurate, current, and complete to the best of your knowledge.

Rootpay reserves the right to modify these Terms, refuse service, restrict access to any portion of the App, or discontinue your access entirely at any time, for any reason or no reason, with or without notice and without liability to you. Violation of these Terms may result in immediate suspension or termination of your account and access to the Services.

While you may browse the App without registration, access to certain features requires you to create a password-protected user account ("Account"). Account creation requires submission of your full name and email address through our registration interface, along with creation of a secure password. You may optionally provide additional information to enhance your user experience, though this is not mandatory for basic registration. However, you must complete KYC/AML Verification as required by our service providers and/or Rootpay before you can utilize the Services.

You bear sole responsibility for maintaining the confidentiality and security of your account credentials (your "Password"). All activities conducted through your Account are your responsibility, and you must immediately notify Rootpay of any security breach or unauthorized access. You may not use another user's Account without Rootpay's explicit permission, and you agree not to misrepresent your identity or impersonate any other user or person.

You acknowledge and agree that you—not Rootpay—are liable for any losses or damages (direct or indirect) resulting from unauthorized use of your Account. Notwithstanding this, you may also be held liable for losses incurred by Rootpay or other users due to such unauthorized access.

As a condition of using the App, you agree to abide by the following account usage policies (the "Account Standards"):

1. You will not reproduce or distribute any component of the App through any medium without obtaining prior written authorization from Rootpay;
2. You will not modify or alter any part of the App except as reasonably necessary to use it for its intended purpose;
3. You will provide accurate, truthful, and current information when registering your Account, and you will keep this information updated throughout the duration of your use;
4. You will not deploy automated systems such as robots, spiders, web scrapers, offline readers, or similar tools to access the App without Rootpay's prior written approval;
5. You will not manually or automatically collect information about other users, including names, contact details, or other personal data, nor will you copy copyrighted materials or misuse App content for competitive purposes or on third-party platforms;
6. You will not send request volumes to Rootpay's servers that exceed what a human user could reasonably generate using standard web browsing methods. Public search engines may use automated crawlers solely to create publicly searchable indices (not caches), though Rootpay may revoke this permission at any time;
7. You will not solicit, recruit, or contact Rootpay employees or App users for employment or business opportunities unrelated to Rootpay without express written permission;
8. You will not take actions that unreasonably burden Rootpay's infrastructure, interfere with the proper functioning of the App, disrupt other users' experience, or circumvent security measures designed to restrict access;
9. You will not harvest or collect personally identifiable information, including Account details, from the App, nor will you use the App's communication systems for unsolicited commercial purposes.

5.3 SUPPLEMENTARY POLICIES

Your access to and use of the App is governed by these Terms as well as all applicable Rootpay guidelines, regulations, and supplementary policies that may be implemented from time to time, including copyright policies and other limitations published on the App (collectively, the "Supplementary Policies"). You agree to comply with these Supplementary Policies at all times. Failure to adhere to these Terms, the Account Standards, eligibility requirements, or Supplementary Policies may result in immediate Account termination without prior notice, and Rootpay may pursue appropriate legal action if warranted.

6.1 CONTENT RESTRICTIONS

When using the Services, you agree not to upload, transmit, post, email, display, distribute, or otherwise make available any content—including text, images, videos, audio, data, software, or live streams—to Rootpay, its personnel, or any part of the App (all such content is collectively referred to as "User Content," and the act of submitting such content is a "Submission") that:

• Misrepresents its origin, impersonates any individual or entity, or contains false biographical details;
• Links to external websites that violate these Terms;
• Is designed to harm or exploit minors (individuals under 18 years of age) in any manner;
• Seeks to collect personally identifiable information from minors, such as names, addresses, phone numbers, email addresses, or school names;
• Violates privacy rights by harvesting, storing, or publishing private or personally identifiable information—including names, email addresses, phone numbers, passwords, credit card details, or home addresses—without knowledge and consent;
• Contains falsehoods or misrepresentations that could harm Rootpay or any third party;
• Is pornographic, harassing, hateful, illegal, obscene, defamatory, libelous, slanderous, threatening, discriminatory, or promotes violence, bigotry, racism, or hatred based on race, culture, ethnicity, or other protected characteristics;
• Encourages criminal conduct, creates civil liability, or violates any applicable law;
• Advocates physical harm, racism, or hatred toward any group or individual;
• Features nudity, graphic violence, or other inappropriate subject matter;
• Is protected by copyright, trade secret, or other proprietary rights (including privacy and publicity rights) unless you own such rights or have obtained permission from the rightful owner to post the material and grant Rootpay all necessary licenses;
• Contains or promotes unauthorized copies of copyrighted works, such as pirated software, music files, circumvention tools, counterfeit goods, or other items that infringe intellectual property or proprietary rights;
• Threatens, stalks, defames, defrauds, degrades, victimizes, or intimidates individuals or groups based on age, gender, disability, ethnicity, sexual orientation, race, religion, or encourages others to do so;
• Is intended to disrupt or damage computer systems, enable illegal software access, bypass security measures, or facilitate spamming;
• Impersonates or falsely claims to be a Rootpay employee, representative, another user, or any other person;
• Advertises or solicits unrelated businesses or services that Rootpay deems inappropriate;
• Constitutes unsolicited bulk email ("spam"), chain letters, pyramid schemes, affiliate marketing, or other unsolicited commercial advertising;
• Promotes fraudulent schemes, discount card scams, credit counseling fraud, deceptive online surveys, or contests;
• Contains or distributes viruses, malware, or other harmful technologies that could damage Rootpay or user systems;
• Includes links to commercial websites or services, except where explicitly permitted by these Terms;
• Is non-local, irrelevant, or off-topic;
• Duplicates content from your previous Submissions; or
• Is generated or submitted through automated devices or programs without Rootpay's express written consent.

6.2 NON-DISCRIMINATION POLICY

United States law prohibits discrimination based on race, color, religion, sex, national origin, age, disability, or other protected classifications. Rootpay will not knowingly accept any Submission that violates these laws. Rootpay reserves the right to immediately remove, without prior notice, any content that violates anti-discrimination laws or these Terms. When using the App, you must not: violate any laws, infringe third-party rights, or breach these Terms or Account Standards; manipulate fee structures or circumvent billing procedures; or post false, misleading, defamatory, or libelous content (including personal information about other users). The examples of prohibited conduct listed above are illustrative and not exhaustive. Rootpay may, at its sole discretion and without notice, terminate your Account access, remove Submissions, refuse service, or take any action it deems appropriate for conduct that is disruptive or inappropriate. Rootpay may report suspected illegal activity to law enforcement and will cooperate with authorities when legally required or appropriate. Rootpay is not obligated to monitor or police User Content.

6.3 USAGE RESTRICTIONS AND ELIGIBILITY

Any use or attempted use of the App is prohibited if it involves:

1. Unauthorized, fraudulent, illegal, or malicious purposes;
2. Actions that could damage, disable, overburden, or impair servers or connected networks;
3. Interference with other users' enjoyment of the App;
4. Unauthorized access to accounts, systems, or networks through hacking, password theft, or other means;
5. Accessing systems, data, or information not intended for user access;
6. Attempts to obtain materials through methods not intentionally provided by Rootpay; or
7. Any purpose other than the App's intended function.

Additionally, you agree not to upload or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content, or content that invades another person's privacy or publicity rights.

Rootpay reserves the right to suspend or terminate your access if we determine, in our sole discretion, that you are using the Services for unauthorized purposes or in ways that expose Rootpay to liability, reputational harm, or brand damage. Prohibited activities include but are not limited to:

1. Unauthorized transactions resulting from account compromise, stolen payment cards, or misappropriated account information;
2. Fraudulent schemes where recipients deceive senders by impersonating others, misrepresenting entities, or promising goods, services, or funds with no intention of delivery;
3. Authorizing fund transfers and subsequently disputing them with financial institutions as unauthorized transactions ("chargeback fraud"); or
4. Illegal activities including but not limited to financing terrorism, sexually oriented materials or services, gambling, or transactions involving tobacco products, firearms, prescription drugs, or controlled substances.

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND SERVICES MUST COMPLY AT ALL TIMES WITH APPLICABLE LAWS, INCLUDING BUT NOT LIMITED TO FOREIGN EXCHANGE REGULATIONS, ANTI-MONEY LAUNDERING STATUTES, BANKING LAWS, TAX LAWS, AND ECONOMIC SANCTIONS.
